Synopsis

This chapter analyzes the procedural requirements for the tutela action in the protection of bioculturality, with an emphasis on how case law has adapted these requirements in relation to ethnic communities. It also examines the relaxation of standing requirements, the principle of subsidiarity, and the requirement of immediacy in cases of ongoing violations or imminent environmental threats, as well as the dynamic and intercultural burden of proof to overcome structural asymmetries. Based on a review of key decisions, it demonstrates how tutela functions as an effective safeguard to prevent irreversible harm.

Diego Fernando Rey-Guerrero, Universidad La Gran Colombia

He holds a Master of Laws from La Gran Colombia University, a law degree from the Nueva Granada Military University, and a degree in economics from the National University of Colombia. He served as a research assistant and fellow for the JCG2023-DER-01 project at La Gran Colombia University.
