The Peace Process and Global Human Rights Governance: Guaranteeing Peace as a Fundamental Right

Synopsis

Peace processes have taken the form of political, legal and social agreements aimed at breaking cycles of violence and accompanying them in new democratic eras within societies. This paper proposes a comparative analysis of peace agreements from two perspectives: The political science approach, which highlights their nature as power pacts and governance mechanisms; and a legal approach, which incorporates exceptional regulatory frameworks designed to guarantee justice, truth, reparation and non-repetition. This demonstrates the importance of ombudsperson, particularly municipal personerias, as they are essential to implement commitments and the sustainability of peace agreements at the local level.
