Is Migration a Human Right? Legal and Political Barriers and State Theory in the Global Era

Synopsis

Migration has been the subject of debate in the fields of law and politics, given its multifaceted nature. From a legal-political perspective, the central question is whether migration constitutes an inherent human right or whether it is governed by rules and principles that limit it or relate to other rights. From a legal-political perspective, migration can be understood as a human right when individual freedoms and respect for human dignity are prioritized, although its exercise is always subject to state regulations and sovereignty. The current trend favors recognizing migration as a fundamental right, promoting policies that protect migrants and their rights.
